These Terms of Service ("Terms") govern the use of services provided by Vanwear ("Company", "we", "us", or "our") for custom clothing creation and branding services. By using our website or services, you ("Client", "you", or "your") agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.

1. Services Provided

Vanwear offers custom clothing creation for businesses, using your provided branding, logos, and designs. Our services include, but are not limited to:

  • Designing and producing custom-branded clothing items (e.g., t-shirts, jackets, uniforms, hats, etc.)
  • Customizing clothing with logos, artwork, and text as per your specifications
  • Providing samples, proofs, and revisions of designs before final production

2. Account Creation and Responsibilities

To access and use our services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information when creating an account
  • Maintain the confidentiality of your account information and password
  • Notify us immediately of any unauthorized use of your account
  • Be solely responsible for all activities conducted under your account

3. Client Materials and Intellectual Property

You retain full ownership and rights to any materials, logos, branding, designs, or trademarks ("Client Materials") you provide to Vanwear. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify the Client Materials solely for the purpose of fulfilling your order. You represent and warrant that:

  • You have the legal right to use and provide the Client Materials
  • The Client Materials do not infringe on any third-party intellectual property rights, trademarks, copyrights, or other proprietary rights
  • You are fully responsible for securing any necessary permissions or licenses for third-party materials used in the designs

4. Customization Process and Approvals

  • Design Submission: After submitting your customization request, our design team will create a mock-up based on your provided specifications. We will provide you with a digital proof for approval.
  • Approval Process: You will have the opportunity to review and approve or request revisions to the design before production begins. Once the design is approved, we will proceed with production.
  • Revisions: Clients are entitled to up to 3 revisions during the approval stage. Additional revisions may incur extra charges.

5. Pricing and Payment

  • Pricing: The pricing for custom clothing is based on the type of garment, quantity, complexity of design, and any other special requirements. A quote will be provided prior to production.
  • Payment: Full payment is required before production begins unless otherwise agreed. Any additional charges for revisions, expedited shipping, or additional services will be billed separately.
  • Taxes: Applicable sales taxes will be added to the total price where required by law.

6. Production and Shipping

  • Production Time: Production timelines will be provided at the time of order. Delivery times may vary based on the complexity of your order, quantity, and current production schedules.
  • Shipping: We will ship your order to the address provided during checkout. Shipping charges are separate from the cost of the clothing and will be added to your invoice. Delivery times depend on the shipping method selected.
  • Delays: While we strive to meet production and shipping deadlines, delays may occur due to unforeseen circumstances (e.g., supply chain issues, weather, or other external factors). We are not liable for any delays beyond our control.

7. Cancellations and Refunds

  • Order Cancellations: Orders can be canceled before production begins. If the order is canceled after production has started, a cancellation fee may apply.
  • Refunds: Due to the customized nature of our products, we do not offer refunds for orders once production has commenced. However, if the item is defective or if we made an error in fulfilling the order, we will work with you to resolve the issue, which may include a replacement or full refund.

8. Quality Assurance and Liability

We take pride in delivering high-quality products, but due to the customized nature of the garments, slight variations in color, size, or design may occur. We are not liable for any issues arising from the following:

  • Incorrect information provided by the Client (e.g., wrong logo files, incorrect measurements, or spelling errors)
  • Minor color or design variations that do not significantly affect the overall look and feel of the product
  • Wear and tear from normal use or improper care of the garment

9. Limitation of Liability

To the maximum extent permitted by law, Vanwear is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services or products, including but not limited to damages for lost profits, business interruptions, or data loss.

10. Privacy

We take your privacy seriously. Our Privacy Policy outlines how we collect, use, and protect your personal information. By using our services, you agree to our Privacy Policy.

11. Changes to These Terms

Vanwear reserves the right to update or change these Terms at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised accordingly. Your continued use of our services after any modifications to these Terms constitutes your acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the court, and you consent to the jurisdiction of such courts.
